1. Acceptance of Terms
By accessing or using MedBookPro, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service. Your continued use of MedBookPro constitutes acceptance of these terms and any future modifications.
2. Description of Service
MedBookPro is a cloud-based medical practice management platform that provides tools for:
- Appointment scheduling and calendar management
- Patient records and clinical documentation
- Billing, invoicing, and payment tracking
- Clinical notes and vitals tracking
- Online patient booking
- Practice reports and analytics
- AI-assisted clinical reference (Medic AI)
MedBookPro is not a medical device and does not provide medical advice. It is a practice management tool designed to help healthcare professionals organise and streamline their administrative and clinical workflows.
3. Beta Programme
MedBookPro is currently offered through a beta programme. During the beta period:
- The service is provided free of charge for up to six (6) months from the date of your account activation
- The service is provided "as is" without warranty of any kind
- There is no guarantee of uptime or availability during the beta period
- Features may be added, modified, or removed without prior notice
- We will provide reasonable advance notice before introducing any paid plans
4. User Responsibilities
By using MedBookPro, you represent and agree that:
- You are a licensed healthcare professional or are authorised by a licensed healthcare professional to use the platform on behalf of a medical practice
- You will enter accurate and complete data into the platform, including patient records, billing information, and practice details
- You are solely responsible for the accuracy and completeness of all information entered into the system
- You will comply with all applicable laws, regulations, and professional standards governing healthcare practice in your jurisdiction
5. Account Terms
To use MedBookPro, you must create an account. You agree to the following:
- One account per user — each individual must have their own account. Account sharing is not permitted.
- You must provide accurate, complete, and current information during registration
- You are responsible for keeping your login credentials secure and confidential
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorised use of your account
6. Patient Data
With respect to patient data entered into MedBookPro:
- You are the data controller. Your practice retains full ownership and control of all patient data entered into the platform.
- MedBookPro acts solely as a data processor on your behalf
- You are responsible for obtaining appropriate patient consent for the collection, storage, and processing of their personal and medical information within the platform
- You are responsible for ensuring your use of the platform complies with all applicable data protection and healthcare privacy laws in your jurisdiction
7. AI Disclaimer (Medic AI)
MedBookPro includes an AI-powered feature called Medic AI. By using this feature, you acknowledge and agree that:
- Medic AI is a clinical reference tool only — it is not a substitute for professional medical judgement, diagnosis, or treatment
- Medic AI does not replace the treating physician. All AI-generated content, suggestions, and responses must be independently verified by the treating physician before being relied upon or applied to patient care
- AI-generated responses may contain errors, omissions, or outdated information
- The healthcare professional is solely responsible for all clinical decisions, regardless of whether AI-generated content was consulted
- MedBookPro is not liable for any clinical outcomes resulting from the use of or reliance on Medic AI
8. Acceptable Use
You agree not to use MedBookPro to:
- Engage in any illegal activity or violate any applicable laws or regulations
- Share your account credentials with any other person
- Reverse engineer, decompile, or disassemble any part of the software
- Use automated tools to scrape, crawl, or extract data from the platform
- Upload malicious content, viruses, or harmful code
- Attempt to gain unauthorised access to other accounts or systems
- Use the platform in any way that could impair its performance or functionality
9. Intellectual Property
MedBookPro owns the platform. All rights, title, and interest in the MedBookPro software, including all source code, design, trademarks, logos, and documentation, belong to MedBookPro and its licensors.
You own your data. All patient data, practice information, clinical records, and other content you enter into MedBookPro remains your property. MedBookPro does not claim ownership of any user content. We only access your data as necessary to provide, maintain, and improve the service.
10. Data Export
You may request an export of your data at any time by contacting us at [email protected]. We will provide your data in a standard, portable format within a reasonable timeframe.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- MedBookPro is provided "as is" and "as available", without warranties of any kind, whether express or implied
- During the beta period, the service is provided without any guarantee of uptime, availability, or fitness for a particular purpose
- MedBookPro is not liable for any medical decisions made using the platform
- MedBookPro is not liable for data loss beyond the reasonable security measures we maintain
- MedBookPro is not liable for any indirect, incidental, special, consequential, or punitive damages
- Our maximum aggregate liability is limited to the total fees you have paid to MedBookPro in the twelve (12) months preceding the event giving rise to the claim
12. Termination
Either party may terminate this agreement at any time:
- You may stop using MedBookPro and request account closure at any time by contacting us
- We may terminate your account if you violate these Terms of Service
- Upon termination, your data will be retained for 90 days to allow for data export
- After the 90-day retention period, all data will be permanently and securely deleted
- You may request immediate deletion of your data at any time
13. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Saint Lucia. Any disputes arising from or relating to these terms or your use of MedBookPro shall be resolved exclusively in the courts of Saint Lucia.
14. Changes to Terms
We may update these Terms of Service from time to time. When we make material changes, we will notify you via email at least 30 days in advance. Your continued use of MedBookPro after the changes take effect constitutes acceptance of the updated terms.
